You wrote a check to a merchant that was returned due to insufficient funds, and we electronically redeposited (or “re-presented”) that check on behalf of the merchant. As long as funds were available in your account, your debt is completely clear; your credit rating will not be affected, and your name will not appear in any “bad check” databases. We offer this service to merchants as an efficient way of recovering bad checks without hammering their customers’ credit ratings.

The two InChek fees you see on your statement are the amount of the check you wrote (which has been credited back to the merchant), and the state-authorized returned check fee (which merchants are allowed to charge to help defray the cost of the Deposit Item Returned (DIR) fee that their own banks charge them when they deposit bad checks). We understand that nobody likes paying fees, but on the bright side, our process generally costs you less than letting the banks toss your check back and forth, and more importantly it preserves your credit rating.

In fact the abbreviation is supposed to stand for “not sufficient funds,” but apparently “nonsufficient” rolls off the tongue so easily that people are willing to overlook its dubious lexical status. But give it time—“nonsufficient” is (mis)used so often that it’s bound to appear soon in a Webster’s near you.

It really is. State law allows businesses to charge a fee (which varies by state) for returned checks and federal banking regulations permit those checks to be redeposited electronically, on the condition that merchants disclose this policy (usually by posting notices on or near the cash register, on their invoices, etc.) to their customers. When a business hires us to handle its returned checks, we are responsible for collecting not just the amount of the check, but the returned check fee as well. (We even provide decals and other means for our merchants to let customers know that we will be electronically redepositing their checks in the event of a return.) Your signed check is considered your acknowledgment of this policy.

Since we often redeposit your check immediately after it is first returned, writing another to the store may cause the amount be paid twice (or—if there isn’t enough money in your checking account to cover both—to have one of them returned again). Your best bet is to make sure you have sufficient funds in your account to cover the check when it is redeposited.

You may revoke your authorization for both your check and the return check fee to be collected electronically by calling us at (888) 525-5504. However, you will still be liable for both the check and fee and your debt will immediately be forwarded to our collections department, unless you make other arrangements.

Your debt will be forwarded to a collections agency which will result in your receiving a letter, phone calls, and could escalate through credit bureau reporting, database reporting (which may prevent you from writing checks at other locations), and legal action. Our goal is to prevent escalation and work with you to resolve this easily.
